The following information is designed to help registered and unregistered users and visitors (collectively “Users” or “You”) understand how we collect, use, disseminate and safeguard the information You provide to us while accessing and using our mobile applications and services, and websites, including: Tic-it.org mobile apps, the Tic-it.org web app for Clients, and other websites and mobile applications and services (collectively, “Services”). These Services include, but are not limited to, Tic-it.org mobile apps, and the Tic-it.org website at Tic-it.org Additional Services may be added at any time. This Privacy Policy is incorporated into the Tic-it.org Terms and Conditions. Your use of the Services and any personal information You provide on the Services remain subject to the terms of this Privacy Policy and our Terms and Conditions. THIS LEGAL AGREEMENT SET OUT BELOW BETWEEN YOU AND TIC-IT.ORG. BY ACCESSING OR USING THE SERVICE YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, ACCEPT AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICES.

“Authorized Account Holder” is defined as the natural person 18 years of age or older who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address for registration on the Website. By inputting a payment method to participate in real money contests, the Authorized Account Holder hereby affirms that the Authorized Account Holder is the lawful owner of the payment method account used to make any deposit(s) on the Website. It shall be a violation of these Terms of Use for any Authorized Account Holder to submit payment using any payment method that is not owned by the Authorized Account Holder. APP Payment made on our site will appear on your statement as US Tournament Golf, LLC. All payments are final. No refunds will be issued. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the person in whose name the account was registered.

Tic-It.org is not responsible for incomplete, illegible, misdirected or stolen entries. If for any reason a Contest is not capable of running as originally planned, or if a Contest, computer application, or website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper entry to a Contest in accordance with the Terms of Use or applicable Contest rules, or if infection by a computer (or similar) virus, bug, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes of any kind, in the sole opinion of Tic-It.org corrupts or affects the administration, security, fairness, integrity, or proper conduct of a Contest, the Company reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, extend, modify or suspend the Contest, and select the winner(s) from all eligible entries received. If such cancellation, termination, modification or suspension occurs, notification will be posted on the Website.

THIS LEGAL AGREEMENT SET OUT BELOW BETWEEN YOU AND TIC-IT.ORG. BY ACCESSING OR USING THE SERVICE YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, ACCEPT AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICES.

Use of the Service requires compatible devices, Internet access, and certain software (third party fees may apply); may require periodic updates; and may be affected by the performance of these factors. High speed Internet access is strongly recommended for regular use. The latest version of required software is recommended to access the Service and may be required for certain transactions or features and to download or use Products and use Virtual Items previously purchased or acquired from the Service. You agree that meeting these requirements, which may change from time to time, is your responsibility.

YOUR ACCOUNT

As a user of the Service, you have an account (Account). Don’t reveal your Account information to anyone else. You are solely responsible for maintaining the confidentiality and security of your Account and for all activities that occur on or through your Account, and you agree to immediately notify Tic-it.org of any security breach of your Account. Tic-it.org shall not be responsible for any losses arising out of the unauthorized use of your Account.

IN-APP PURCHASES

Products may include functionality that enables you to receive additional services, or licenses to additional functionality or content for use within the Product (In App Purchases). Once a consumable In App Purchase is acquired and received by you, Tic-it.org shall be without liability to you in the event of any loss, destruction, or damage. All In App Purchases are deemed Products, and treated as such, for purposes of these terms and conditions.

You must enter your payment details to acquire In-App Purchases when prompted, once you have entered your payment details to obtain an In-App Purchase and the transaction was approved .In regards to a specific contest operated as the Authorized Administrator/Authorized Account Holder, the administrator and its parties are responsible for refunds and administration of a specific game or contest. All entry payments to a specific game is deposit directly to the Authorized Administrator/ Authorized Account Holder. Tic-it.org does not accept payments by any individual supporter for a specific game or contest. Tic-it.org is not responsible for prizes, prize package values, prize distribution or refund.

Tic-it.org is not responsible for lost or stolen gifts and ticket sales transmitted electronically pass to the purchaser upon electronic transmission to the recipient.

Tic-it.org reserves the right to close accounts and request alternative forms of payment if is fraudulently obtained or used on the Service.

ELECTRONIC CONTRACTING

Your use of the Services includes the ability to enter into agreements and/or to make transactions electronically. YOU ACKNOWLEDGE THAT YOUR ELECTRONIC SUBMISSIONS CONSTITUTE YOUR AGREEMENT AND INTENT TO BE BOUND BY AND TO PAY FOR SUCH AGREEMENTS AND TRANSACTIONS. YOUR AGREEMENT AND INTENT TO BE BOUND BY ELECTRONIC SUBMISSIONS APPLIES TO ALL RECORDS RELATING TO ALL TRANSACTIONS YOU ENTER INTO ON THIS SITE, INCLUDING NOTICES OF CANCELLATION, POLICIES, CONTRACTS, AND APPLICATIONS.

PRODUCT MAINTENANCE AND SUPPORT

Tic-it.org will be responsible for providing any maintenance and support services with respect to the Products, as specified in the Tic-it.org Terms, or as required under applicable law.

INTELLECTUAL PROPERTY

You agree that the Service, including but not limited to Products, graphics, user interface, audio clips, video clips, editorial content, and the scripts and software used to implement the Service, contains proprietary information and material that is owned by Tic-it.org and is protected by applicable intellectual property and other laws, including but not limited to copyright. You agree that you will not use such proprietary information or materials in any way whatsoever except for use of the Service in compliance with this Agreement. No portion of the Service may be reproduced in any form or by any means, except as expressly permitted in these terms. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Service in any manner, and you shall not exploit the Service in any unauthorized way whatsoever, including, but not limited to, by trespass or burdening network capacity.

Notwithstanding any other provision of this Agreement, Tic-it.org reserve the right to change, suspend, remove, or disable access to any Products, content, or other materials comprising a part of the Service at any time without notice. In no event will Tic-it.org be liable for making these changes. Tic-it.org may also impose limits on the use of or access to certain features or portions of the Service, in any case and without notice or liability.

DISCLAIMER OF WARRANTIES; LIABILITY LIMITATION

YOU EXPRESSLY AGREE THAT YOUR USE OF, OR INABILITY TO USE, THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SERVICE ARE (EXCEPT AS EXPRESSLY STATED BY TIC-IT.ORG) PROVIDED AS IS AND AS AVAILABLE FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, THE ABOVE EXCLUSION OF IMPLIED WARRANTIES MAY NOT APPLY TO YOU.

IN NO CASE SHALL TIC-IT. ORG , ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF ANY OF THE SERVICE OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICE, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, TIC-IT.ORG LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.

ORG SHALL USE REASONABLE EFFORTS TO PROTECT INFORMATION SUBMITTED BY YOU IN CONNECTION WITH THE SERVICE, BUT YOU AGREE THAT YOUR SUBMISSION OF SUCH INFORMATION IS AT YOUR SOLE RISK, AND TIC-IT.ORG HEREBY DISCLAIMS ANY AND ALL LIABILITY TO YOU FOR ANY LOSS OR LIABILITY RELATING TO SUCH INFORMATION IN ANY WAY.

TIC-IT. ORG DOES NOT REPRESENT OR GUARANTEE THAT THE SERVICE WILL BE FREE FROM LOSS, CORRUPTION, ATTACK, VIRUSES, INTERFERENCE, HACKING, OR OTHER SECURITY INTRUSION, AND TIC-IT.ORG DISCLAIMS ANY LIABILITY RELATING THERETO.

WAIVER AND INDEMNITY

BY USING THE SERVICE, YOU AGREE, TO THE EXTENT PERMITTED BY LAW, TO INDEMNIFY AND HOLD TIC-IT. ORG , ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND LICENSORS HARMLESS WITH RESPECT TO ANY CLAIMS ARISING OUT OF YOUR BREACH OF THIS AGREEMENT, YOUR USE OF THE SERVICE, OR ANY ACTION TAKEN BY TIC-IT. ORG AS PART OF ITS INVESTIGATION OF A SUSPECTED VIOLATION OF THIS AGREEMENT OR AS A RESULT OF ITS FINDING OR DECISION THAT A VIOLATION OF THIS AGREEMENT HAS OCCURRED. THIS MEANS THAT YOU CANNOT SUE OR RECOVER ANY DAMAGES FROM TIC-IT. ORG , ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND LICENSORS AS A RESULT OF ITS DECISION TO REMOVE OR REFUSE TO PROCESS ANY INFORMATION OR CONTENT, TO WARN YOU, TO SUSPEND OR TERMINATE YOUR ACCESS TO THE SERVICE, OR TO TAKE ANY OTHER ACTION DURING THE INVESTIGATION OF A SUSPECTED VIOLATION OR AS A RESULT OF TIC-IT. ORG CONCLUSION THAT A VIOLATION OF THIS AGREEMENT HAS OCCURRED. THIS WAIVER AND INDEMNITY PROVISION APPLIES TO ALL VIOLATIONS DESCRIBED IN OR CONTEMPLATED BY THIS AGREEMENT.

Tic-it.org reserves the right at any time to modify this Agreement and to impose new or additional terms or conditions on your use of the Service. Such modifications and additional terms and conditions will be effective immediately and incorporated into this Agreement. Your continued use of the Service will be deemed acceptance thereof. Tic-it.org reserves the right to take steps Tic-it.org believes are reasonably necessary or appropriate to enforce and/or verify compliance with any part of this Agreement. You agree that Tic-it.org has the right, without liability to you, to disclose any Registration Data and/or Account information to law enforcement authorities, government officials, and/or a third party, as Tic-it.org believes is reasonably necessary or appropriate to enforce and/or verify compliance with any part of this Agreement (including but not limited to Tic-it.org right to cooperate with any legal process relating to your use of the Service and/or Products, and/or a third party claim that your use of the Service and/or Products is unlawful and/or infringes such third party’s rights).
